Terms and Conditions of Stay
Reservation, payment and contractual provisions for guests of The Nest at Black Hawk.

Deposits, Fees & Triggered Charges
The following amounts apply only when selected, required, or triggered by guest conduct. Taxes may apply where required. Documented costs may exceed a stated minimum or deposit when actual repair, replacement, remediation, or lost-use costs are higher.
1. Acceptance of Terms and Primary Guest Responsibility
These Terms and Conditions and the separate Guest Rules together apply to all reservations, registered occupants, visitors, pets, accommodations, common areas, amenities, and activities at The Nest at Black Hawk ("The Nest"). Rate-specific, package-specific, group, event, or third-party booking terms may supplement these documents.
The person whose name appears as the primary guest on the reservation is responsible for the reservation, payment, the conduct of all occupants and visitors, and all charges arising from their actions. The primary guest must provide these policies to every person in the party and ensure compliance.
Entry onto the property and continued occupancy are conditioned on compliance with these Terms and Conditions, the Guest Rules, posted notices, safety instructions, and reasonable directions from authorized staff.
2. Reservations, Eligibility, Identification and Length of Stay
Unless The Nest approves otherwise in writing, the primary registered guest must be at least 21 years old. A valid government-issued photo ID and a valid payment card in the primary guest's name must be presented at check-in.
Guests must provide accurate names, contact information, occupancy details, vehicle information, and pet information. Reservations may not be sold, assigned, or transferred to another person without prior written approval from The Nest.
The Nest is a cashless property. All room balances, deposits, fees, and incidental charges must be paid using an accepted electronic payment method.
A reservation is not considered fully secured until all required payments, deposits, identification, and registration information have been received.
The maximum stay is 14 consecutive nights unless The Nest approves a longer stay in writing. A resort stay is transient lodging and does not create a residential tenancy or right to continued occupancy.
3. Pricing, Payments and Failed Charges
Non-Refundable Reservations
Reservations booked under a non-refundable rate require full payment at the time of booking. These reservations remain non-refundable and non-changeable regardless of the date of cancellation, except when The Nest expressly agrees otherwise in writing or applicable law requires a different result.
Standard or Flexible Reservations
For reservations not identified as non-refundable, any remaining balance will be automatically charged at or after 4:00 PM Mountain Time 14 calendar days before the scheduled arrival date. Reservations made within 14 calendar days of arrival require full payment at booking.
Failed or Declined Payments
If an automatic payment is declined, The Nest will send notice using the email address, telephone number, or other contact information associated with the reservation. The outstanding balance must be paid within 24 hours after the notice is sent. If payment is not received within that period, The Nest may cancel the reservation without further notice. Reinstatement is not guaranteed and is subject to availability, current rates, and applicable restrictions.
Price and Fee Disclosure
Known mandatory lodging charges and selected optional add-ons will be disclosed before payment is requested. Charges that depend on later guest choices or conduct, including additional guests, pets, damage, missing items, smoking, excessive cleaning, or late departure, may be assessed when selected or when the triggering condition occurs.
4. Incidental and Damage Authorization
A $100 incidental and damage authorization hold is placed on the payment card at check-in. This hold is separate from the $250 refundable pet deposit required for guests traveling with declared pets.
After check-out and inspection, The Nest will initiate release of any unused authorization or refund any refundable deposit balance. Many financial institutions make released funds available within approximately 5 to 7 business days, but processing may take longer. The Nest does not control a bank or card issuer's processing time.
An authorization hold or deposit is not a limit on the guest's responsibility. If charges exceed the amount held or deposited, the primary guest remains responsible for the full balance.
5. Cancellation, Reservation Changes, No-Shows and Early Departures
Non-Refundable Rates
Reservations booked under a non-refundable rate are charged in full at booking and are non-refundable and non-changeable, regardless of when the cancellation or change request is made.
Standard or Flexible Rates
A standard or flexible reservation may be canceled or changed without penalty until 4:00 PM Mountain Time exactly 14 calendar days before the scheduled arrival date. A timely cancellation will receive a full refund of amounts paid for that reservation to the original payment method.
At 4:00 PM Mountain Time 14 calendar days before arrival, the reservation becomes locked, non-refundable, and non-changeable. Cancellations, date changes, reductions in the number of nights, no-shows, and early departures after that cutoff result in forfeiture of 100% of the reservation cost.
Changes Before the Cutoff
Changes requested before the applicable cancellation cutoff are subject to availability and to the rates, minimum-stay requirements, packages, restrictions, and policies in effect for the new dates. Any price difference will be reflected in the revised reservation and any additional balance is due when the change is confirmed.
Third-Party Reservations
Reservations made through an online travel agency, travel advisor, group organizer, or other third party must generally be canceled or changed through that party and remain subject to the rate terms presented at booking.
Travel Disruptions and Personal Circumstances
Weather, road conditions, flight disruptions, illness, schedule changes, and other personal circumstances do not automatically waive the cancellation policy. Guests are encouraged to consider travel insurance for circumstances that may interrupt a trip.
6. Dome Assignments and Accessibility Requests
The Nest will make reasonable efforts to honor requests for a particular dome, view, location, or feature, but specific unit assignments are not guaranteed unless expressly confirmed in writing. When necessary, The Nest may provide another accommodation within the reserved category or an accommodation of comparable or greater value.
Guests requesting an accessible accommodation, communication aid, or reasonable modification should contact The Nest as early as possible. Accessibility requests will be addressed in accordance with applicable law and availability.
7. Damage, Additional Charges and Payment Authorization
By making a reservation, checking in, or providing a payment method, the primary guest authorizes The Nest to charge the payment method on file for unpaid lodging balances, additional registered or unregistered guests, pet charges, the Undeclared Pet Fee, smoking remediation, late departure, excessive cleaning, missing property, damage, repair, replacement, pest treatment, lost-use costs, and other amounts permitted under these policies.
Charges may be assessed after departure and may exceed the incidental authorization hold or pet deposit when the documented cost is higher. An itemized explanation of post-stay charges will be provided upon request.
If the payment method on file is declined or unavailable, the amount remains due and the primary guest is responsible for promptly providing another accepted payment method.
8. Personal Property, In-Room Safes and Lost & Found
Guests are responsible for securing their personal property, locking their dome and vehicle, and using any in-room safe in accordance with the posted instructions. The Nest's responsibility for lost, stolen, or damaged property is limited by applicable law.
Found property may be retained for up to 30 days after departure. Perishable, hazardous, illegal, contaminated, or unsanitary items may be discarded immediately. Unclaimed property may be discarded, donated, or otherwise disposed of after the retention period.
At the guest's request and when reasonably practical, The Nest may arrange shipment of found property. The guest is responsible for packaging, shipping, insurance, and handling charges. The Nest does not guarantee recovery of lost items.
9. Right of Entry and Maintenance
The Nest may enter a dome without prior notice when reasonably necessary to respond to an emergency, protect life or property, address a safety concern, perform urgent maintenance, conduct a welfare check, investigate a reported or reasonably suspected policy violation, prevent further damage, or comply with legal requirements.
When practical, reasonable notice will be provided for routine maintenance, inspections, or non-urgent service. Guests may not obstruct authorized staff from entering when entry is reasonably necessary.
10. Removal, Refusal of Service and Termination of Stay
The Nest may refuse service, require a person or animal to leave, or terminate a stay when reasonably necessary to address nonpayment, fraud, an occupancy violation, an undeclared or unauthorized pet, smoking or fire-safety violations, property damage, excessive noise, harassment, threats, violence, illegal conduct, unsafe behavior, refusal to follow staff instructions, or any serious or repeated violation of these policies.
A guest removed or whose stay is terminated for a policy violation is not entitled to a refund for unused nights or services and remains responsible for all lodging charges, fees, damage, cleaning, replacement, remediation, response costs, and other amounts arising from the stay.
The Nest may contact law enforcement, fire personnel, animal control, emergency services, or other authorities when appropriate. Enforcement will be carried out consistently with applicable law and without unlawful discrimination.
11. Resort Closures, Force Majeure and Service Interruptions
The Nest may suspend, relocate, shorten, or cancel a stay when the property or accommodation cannot reasonably operate because of severe weather, wildfire, evacuation, utility failure, structural or mechanical concerns, government order, labor or supply disruption, public emergency, or another circumstance beyond reasonable control.
If The Nest cancels a reservation before arrival, or shortens an in-progress stay, because the reserved lodging cannot be provided, The Nest will refund the lodging amounts paid for the canceled and unused portion unless the guest accepts a relocation, credit, or other written arrangement. To the extent permitted by law, The Nest is not responsible for airfare, rental cars, alternate lodging, lost wages, or other indirect or consequential travel expenses.
The Nest may modify hours, limit access, or temporarily close an amenity, fire feature, common area, trail, or service when reasonably necessary. A temporary amenity interruption does not automatically qualify a reservation for a refund, rate reduction, or cancellation waiver unless the reserved package expressly guarantees that amenity or applicable law requires otherwise.
If the lodging remains available and habitable but a particular amenity or service is temporarily unavailable, the interruption does not automatically alter the cancellation policy.
12. Operational Communications and Written Approvals
The Nest may use the email address, telephone number, text-message number, or booking-platform account associated with the reservation to send payment notices, arrival instructions, safety alerts, policy notices, and other operational communications. Guests are responsible for keeping their contact information current and monitoring those communications.
A requirement for prior written approval is satisfied only by a confirmation from an authorized representative of The Nest through email, text message, booking-platform message, or another written record. A verbal conversation or unconfirmed request does not constitute approval.
13. Governing Terms, Severability and Policy Updates
These policies are governed by applicable federal law and the laws of the State of Colorado. Any rate plan, package, group agreement, event agreement, or written accommodation approved by The Nest may supplement these policies. When a specific written term directly conflicts with a general term in this document, the more specific written term controls for that reservation.
If a provision of these policies is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law. A failure by The Nest to enforce a provision on one occasion does not waive the right to enforce it later.
The Nest may update these policies prospectively. The version accepted at booking or check-in generally governs the stay, except that The Nest may immediately apply changes required by law or reasonably necessary for health, safety, security, or emergency operations.
